We are providing you with these terms and conditions (“Terms”) containing information on general use of the EPIK service (“EPIK” or the “Service”), which you might need or be curious about while using the Service. Through these Terms, you can find information on your rights, responsibilities, and other information relating to SNOW Corporation (“we” or “Company”) and you (“you” or “Members”). These Terms are posted on the Service so that it can be easily accessible at any time. Company will do its best to continuously provide you with a reliable service, and we hope that the following information will help make the Service more accessible for you.
The capitalized terms used in these Terms have the meaning below:
“Service” refers to EPIK and EPIK-related services that can be used across devices (including PC, TV, mobile devices, and other wired or wireless devices).
“you” or “Members” refers to customers who are accessing and using the Service and entering into a service usage agreement in accordance with these Terms.
“Content” refers to any writing, photos, videos, files, and links that you post on the Service in the form of symbols, letters, voice notes, sounds, faces, images, or videos.
These Terms will be posted so that it is easily accessible and will be amended after prior notice.
Company will upload these Terms on the Service or the connection page. These Terms may be amended in compliance with applicable laws. When Company amends these Terms, Company will give you at least 7 days’ prior notice, and the notice will include the reasons for amendment and the date of application. However, if the amendment has the possibility of impacting you adversely, notification will be provided in the Service least 30 days in advance, and you will be individually informed through emails or other means of communication.
If you do not expressly refuse the proposed changes after Company has notified you of intended amendments to these Terms, Company shall deem this as consent to the amended Terms. If you refuse to give consent to the amended Terms, Company will be unable to apply the amended Terms, and you are free to terminate the service usage agreement. However, if there are special circumstances in which Company cannot apply the unamended Terms, Company may terminate the service usage agreement. Even if a part of these Terms is determined to be inapplicable, the rest of the Terms shall continue to take effect.
These Terms and the Operation Policy are complementary, and you agree to EPIK’s Terms of Use for Paid Products and Services if you purchase any paid services while using EPIK.
Company may have an additional agreements or an operation policy (“Operation Policy”) for individual services. Any items or interpretations not mentioned in this service usage agreement shall be decided according to separate operation policies, relevant legislation, or customs. Furthermore, if you purchase any paid services provided by the Service, you agree to be bound by the EPIK Terms of Use for Paid Products and Services.
There are multiple steps involved in the actual use of the Service.
The service usage agreement is executed when an applicant (the “Applicant”) agrees to these Terms, applies to be a member, and when Company accepts this application. Company will generally accept the application for use of the Service. However, there are several circumstances where Company may refuse the application or cancel the service usage agreement after the confirmation of the application. Firstly, if the Applicant has previously lost their membership status, Company may refuse the application. This does not apply if the applicant has received permission for re-application by Company. Secondly, if the Applicant supplies false information or fails to supply the information that Company requested, Company may refuse the application. Thirdly, the application may be rejected for causes attributable to the Applicant or if the applicant violated any prior rules and regulations. Next, nobody under the age of 16 may use the Services provided by EPIK, and this restriction also applies to EPIK-related services. Furthermore, with respect to using select EPIK’s AI Services (AI 3D Toon, etc.), you must be at least 19 years or older. You agree that you will not misrepresent your age when using the Services. Furthermore, if Company is lacking in service-related equipment or if our company is having technical or business-related problems, acceptance of applications may be delayed.
If your application has been refused or delayed because of the aforementioned reasons, Company will notify you in principle. The service usage agreement shall enter into effect when Company has accepted and notified the acceptance of the application. The Company may offer graded access to its Services (including restriction of time, frequency of use, and service menus) based on the Operation Policy.
You may alter your personal information at any time.
You are free to access and edit your personal information through the profile window, and you shall edit your profile should any of the information you have entered at the time of application change. Company is not responsible for any disadvantages caused by failure to do so.
Company will try its best to protect your personal information.
Company protects your personal information in accordance with applicable laws and the protection and use of personal information are governed by such legislation or privacy policy. However, if a Member shares child pornography, large amounts of pornographic content, or if we judge that the content is a threat to life, Company may provide relevant information to government authorities regardless of the privacy policy. In addition, Company may access your Content if there is a need for confirmation of non-violation of related legislation or the service usage agreement, and Company may provide the content of posts or chats to government authorities in order to abide by relevant legislation.
Should you not access the Service for a certain amount of time, exemplified by a lack of login or access history, Company will notify you via electronic means including e-mail, in-service notifications, or others, and either destroy your information or store it separately. Should you still fail to access the Services, Company may cancel the service usage agreement.
The privacy policy of Company does not apply to other websites that are linked to the official website.
Company will notify you of the important information and accept your opinions actively.
When Company decides to inform you of important information, it shall do so via means deemed acceptable by Company, unless otherwise stated in these Terms.
In addition, if Company deems that your complaints or opinions regarding the use of the Service are justified, it will try its best to process them. You will be informed of the process through customer service or other means that Company deems appropriate.
Please respect the rights of other Members and the Service.
Company owns, holds and reserves the copyright and other intellectual property rights to the Service, but this does not apply to the Contents that you create. The designs provided by Company, text, script, graphic, code, illustrations, designs, icons, photos, videos, inter-personal transmission service provided by Company and all its related logos, service marks, and trademarks are either owned by Company or Company has the rights of ownership or use under relevant legislation.
Company only gives its Members the rights to use the Service in accordance with the terms and conditions set by Company. You may not dispose the Service or the rights granted hereunder in any manner including without limitation transfers, sales, or offers as security the Service or the rights granted to you. You are granted the rights solely to use the Service in accordance with these Terms and no other rights including ownership or copyright to the Service is granted to you. Your use of the Service must be limited to accessing information on the Service or for personal use.
Unless specifically stated in these Terms of Use, you may not copy or circulate the text, script, or graphics made by Company, which includes using, copying, or circulating member status information accessed through the Service to make a profit. Unless you have an explicit permission from Company in written form, you are not allowed to extract the source code, decompile or create other products related to the Service or its software.
Furthermore, the Service may include certain third-party technologies and your use of the Service is subject to the terms and conditions of third-party technologies as set forth below:
Stability AI. Members agree that Stability AI and its licensors do not grant any warranty and will not have any direct or indirect liability to Members. Furthermore, Members agree that Stability AI is a third party beneficiary to the service use agreements executed between Members and Company, and Stability AI has the right (and will be deemed to have accepted the right) to enforce the agreement against Member as a third party beneficiary thereof.
We will handle the Content you submit carefully.
Company believes that your Content distributed to others through our Service, will make everyone’s life better and richer. Contents include any posts or files including symbols, letters, voice notes, videos, sounds, photos, drawings, or links that you upload to the service to share with yourself or others.
Company promises to handle all your Content that expresses your thoughts and emotions with care. Any intellectual property rights to the Content created by you will remain with you.
To lawfully provide the Contents you upload through the Service, Company requires the rights to use (a worldwide perpetual license free of charge) including the rights to save, copy, edit, transmit, display, share, and create derivative works (solely for translation). By submitting or posting Contents in the Service, you are granting the Company such rights, as well as representing and warranting that you hold those rights to the Contents you post.
Company may use the rights of use lawfully granted to us by you for the following purposes: exposure within the Service; advertisement of the Service; operation and improvement of the Service; research and development of new services; compliance to web accessibility requirements and other responsibilities set by the law; search, collection and linking from/of external websites.
The Contents that you provide may be used by Company and its subsidiary companies for research and development purposes to improve existing services and to create new ones. Company will do its best to provide more useful services to you through continuous research and development endeavors.
The Company is trying its best to let you easily control your Content and access to your Content by other Members through various means. When you choose to publish or submit your posts publicly, you consent to the Company's use of your posts on its forums (e.g., templates) available publicly within the service for all users to view. You also consent to other users' use (including edited templates used in posts via the sharing feature) of your posts in accordance with these Terms of Use. When publishing or submitting your posts (or afterward), you may delete the content or make them private using the management features to directly control the accessibility of your Content. Alternatively, you may request deletion of the content, make the content private, and exclude the content from search and other access options through our customer service; however, the aforementioned actions may be difficult to process in certain cases.
EPIK’s AI Services. In order to use EPIK’s AI services (including the AI Yearbook service and other technologies and features incorporating artificial intelligence algorithms, hereafter “AI Services”) feature, you will submit your photos to generate or use the AI Services. You consent that Company will use your photos to teach the AI algorithms solely for the purpose of generating your deliverables resulting from your use of the AI Services. However, your photos will be deleted immediately after the deliverables resulting from your use of the AI Services are complete. You must not use or submit any photos that violate any of these Terms or to which you do not have all the necessary rights. You agree to indemnify, defend, and hold Company and its affiliates harmless against any losses or claims arising out of or relating to your use of the photos in violation of these Terms.
There are a few rules you are expected to follow in using the Service.
The following actions are strictly prohibited to promote the correct use of our Services: entering false information when making an application or editing personal information; using other people’s information without permission; collecting, sharing, or providing personal information, registration information, or access histories of other Members; causing harm to account security by allowing others to access your account; circulating false information to yield profit for oneself or others or to cause harm to others; using the Service to promote or facilitate inappropriate relationships, and using the Service to criticize or defame other persons.
Any act of using the Service for profit unless given permission by Company and altering any information provided by Company are strictly prohibited. Furthermore, impersonation, illegal use of other names or Company’s name, violation of copyright and intellectual property rights, defamation, or any actions that may cause work disturbances are also prohibited. You are also not allowed to (i) sell, license, distribute, transfer or otherwise make available our Services or the technologies included in our Services to any third party, (ii) modify or prepare any derivative work based upon our Services or any of the technologies included in our Services, (iii) reverse engineer, disassemble, decompile our Services or any of the technologies included in our Services or attempt to discover or disclose our source code, or (iv) make any representations or warranties about our Services or the technologies included in our Services that are false or misleading. In addition, transmitting or posting information not designated by Company (including computer programs), posting or sharing violent messages, videos, sounds, or other information deemed inappropriate by social customs, or sharing false information or impersonating others are also strictly prohibited.
Any actions that condone or promote the actions mentioned above are also strictly prohibited. You shall abide by relevant legislation, these Terms, Operation Policies, Service use information and instructions, and any other announcement of notices regarding the use of the Service. Furthermore, you may not commit any actions that may disturb Company’s business or operation of the Service.
Your access to the Service may be restricted.
Although Company promises to handle your Content containing your information and opinions with care, we do not check or monitor all the Content. If your Content is deemed inappropriate according to the Act on Promotion of Information and Communication Network Use and other data and privacy protection laws (collectively “Communication Law”), copyright law, related regulations for communication network, Terms or Operation Policy, or if the Content is deemed inappropriate for the Service Company provides, Company may delete the Content or refuse to share it on the Service.
Please refrain from sharing Content or messages (including comments) that other people may not want to receive. In particular, Content or messages that may cause distress to others. Also, please use the services legally. Any use of the service for illegal purposes is strictly prohibited.
If the Content created by you contains any illegal information as determined by relevant legislation, the right-holder may request that you take the Content down, and Company will take actions in accordance with relevant legislation. Furthermore, even if there is no specific request by the right-holder with regards to the Content, if, for any reason, the Content is deemed inappropriate or evidence of a violation of relevant legislation is present, Company may delete/restrict access to such Content, or take temporary actions with respect to the meetings containing such violating Contents.
If you breach these Terms or hinder the normal operation of the Services, Company may restrict your use of the Service through means of warning, temporary suspension, and permanent suspension, etc. Notwithstanding anything to the contrary, Company may impose permanent suspension on the use of the Service immediately to prevent further abuse of the Services provided, including without limitation, the provision of illegal programs, illegal communication or hacking, circulation of malicious programs, failure to observe access rights, machine access, any violation of related legislation including but not limited to abnormal service use or trying methods prohibited by Company. If a permanent suspension is issued, any benefits that you may have acquired through the use of the Services shall be extinguished, and Company will not grant nor be liable for any compensations. The details of such suspension will be available in the Operation Policy.
Should Company restrict your use of the Service or terminates the Service usage agreement, Company will notify you of these decisions. In this case, you may appeal such decision through procedure provided by Company. If Company deems your appeal to be justified, the suspension on use of the Service will be lifted.
We are against the sharing of child pornography, and such actions will not be tolerated.
Children and young adults are our future and need to be protected by society. To ensure that they form the right values and grow into healthy members of society, Company will try its best to provide a safe space.
Any actions relating to facilitating/promoting sexual services or actions, threats of sharing private images and videos, or standard pornography will be considered child pornography. Even if the Content was shared to promote awareness of child sexual abuse, if it contains explicit content, it may be deemed to be child pornography as well.
If Company discovers any pornographic content involving a minor, it shall take immediate action. Furthermore, Company will take maximum disciplinary action available on the Service against the Member who uploaded such Content as well as take actions in cooperation of government authorities, including provide relevant information to such government authorities.
Company will always be ready to receive your reports regarding child pornography. We will also try our best to continue to protect minors from such threats. Please refer to the section on child protection within EPIK for more detail.
Company will try its best to provide a stable service.
Company provides its Service comprising of EPIK and other associated services developed by Company or other entities through partnership agreement etc. Although the Service is to be provided 365 days a year, 24 hours a day, in principle, Company may offer graded access to the Service depending on users’ confirmation of identity, provision of registration information, or other conditions set by Company.
In addition, Company may suspend the provision of Services temporarily for reasons such as inspection and maintenance of computers and other networking equipment, exchange or breakdown of equipment, loss of network connection, or any operational problems. In this case, Company shall notify you in advance through means deemed acceptable by Company. However, Company may inform you of such circumstances after temporary suspension of Service if there is a justifiable reason. Furthermore, Company may conduct regular maintenance and inspection for better provision of Service, and service hours will be notified through the Service.
The Services may be altered from time to time.
Company may alter the Service provided partly or as a whole following the operation or technical needs. If there is a change to the content, usage, and availabilities of the Service, Company will notify you through adequate means beforehand. The notification will include information such as the reasons for the change, the content of the change, and the date on which such changes come into effect.
Company can alter, suspend or change part or all of the Services provided fee of charge in accordance with Company policies or operational needs. Unless specified by the law, Company shall not provide any compensations for such changes.
Company may provide various information and advertisements.
You may be required to view advertisements to use the Service. This allows us to provide you with various Services for free, as well as serve as a foundation of investment for further research for the development of better Services.
Company can provide various information deemed necessary for Service use through notifications and notices within the Service. Unless it is information on transaction or response to user’s questions in accordance with applicable laws, you may choose to restrict these notifications. If Company decides to send advertisement information for profit through SMS or other transmission devices, we will do so after receiving your prior consent.
Company may upload advertisements with respect to the Service on its Service page, noticeboards, or websites. You may not change, restrict or edit the posts relating to the Services the Company provides.
You are free to terminate whenever you want.
You may apply to terminate the service usage agreement through the account deletion function provided in the Service at any time, and Company shall promptly deal with your request in accordance with relevant legislation. Should you terminate the agreement, all of your data will be deleted and not retrievable, unless Company stores any information per its privacy policy and the applicable laws.
When you terminate your agreement, any identifiable information, such as a profile photo, that is registered in your account will be deleted. However, any posts that are saved or scrapped by other members, or any posts shared to a community notice board will not be deleted. Should you wish to delete such posts, you should do so before you terminate your agreement.
There are exceptional circumstances to Service operation responsibilities.
Company will not be held liable for the failure of provision of Services in the event of natural disasters or any other force majeure event that makes it impossible to provide the Service. In addition, Company will not be held responsible for difficulties in network connection or access for cause attributable to you, such as the loss of a device or access media.
In addition, Company disclaims any warranty on the trustworthiness or accuracy of the information or data posted on the Service, or any transaction carried out through the Service, and Company shall not be liable for any harm caused by any information or data posted on the Service. Furthermore, Company disclaims any responsibility or liability related to or arising from any Service provided free of charge, unless explicitly stated otherwise in the applicable law.
Should there be a legal issue regarding these Terms or between Company and you, it shall be governed by Korean laws, and resolved following the procedures outlined by the Korean Civil Procedure Code.
Warranties relating to EPIK’s AI Services. EPIK’s AI Services features use external AI technology. Due to this, Company cannot fully control the results or deliverables generated by the AI Services, and therefore these deliverables in no way represent our official policy or position on religion, ethnic group, club, organization, company, individual, or anyone or anything. Company makes reasonable efforts to moderate the deliverables from its AI Services, by configuring the AI settings, which, in any case, are only those that Company can access. Company does not and cannot moderate user content. By agreeing to the Terms and/or purchasing the AI Services and the ultimate deliverables, you agree to the above disclaimer and waive any claims against Company due to the generated deliverables.
